The Carrier » Phoenix Helicopter Academy Ltd N° 7223824
The Aircraft » Any aircraft or seat in the aircraft which is the subject of the flight agreement between the carrier and the passenger(s).
The Flight Schedule » The place of departure, place of destination and any stopping points together with any indications of departure and arrival times between the carrier and the passenger(s).
The Agreement » Any arrangement between the carrier and the passenger(s), for the charter of Aircraft or seats in the Aircraft from the carrier.
The Passenger(s) » Person or persons holding a valid flight experience voucher.
The Carrier shall provide for the Passenger(s) use, the Aircraft, manned and equipped for the performance of the Flight Schedule.
The captain of the Aircraft shall have absolute discretion to:
Refuse any passenger(s), baggage or cargo or any part thereof,
Decide what load may be carried on the Aircraft and how it should be distributed,
Decide whether and when the Flight Schedule may be safely undertaken and where and when the Aircraft should be landed.
Due to the present security implications in aviation the commander has absolute right to search cargo, baggage or passengers without suspicion or cause.
Whilst every precaution is taken for the safety of the Passenger(s), The Carrier cannot be held liable for the loss, damage or injury which does not result from The Carrier's negligence. Those wishing to take cameras and other photographic equipment on the flight do so entirely at their own risk.
Gift Vouchers offered have restrictions applied to their sale with reference to age, weight, physical size, and mobility. The Carrier will not be responsible for any unsuitable vouchers being purchased and these restrictions being breached. Every passenger(s) safety is of paramount importance; therefore, The Carrier retains the right to refuse to fly anybody we feel unfit to fly. In such a case any refund will be at the company’s discretion. The aircraft captain reserves the right to delay, cancel or abort a flight at his discretion due to a passenger becoming ill or behaving inappropriately.
Passenger(s) MUST be able to fully understand verbal instructions given in English before, after and during the flight and must ensure their own good health, obtaining medical advice if appropriate.
WEIGHTS: The Robinson R22 (used for Trial Lessons), maximum seat limit is 16 stone/101kg; The Robinson R44 (used for Trial Lessons and Pleasure Flights) maximum seat limit is 18 stone/114kg; for the Cabri G2 (used for Trial Lessons) the maximum seat limit is 16 stone/101kg. The maximum overall aircraft weight is determined by Mass and Balance/Centre of Gravity calculations for the aircraft, therefore all flights will be subject to passenger versus overall take off weight.
The Carrier must be informed in advance of any passenger(s) weighing 15 stone (95kg) or over or standing 6ft 3in (190cm) or over.
Should a passenger(s) be particularly tall or of large build The Carrier would recommend contacting the branch to arrange a visit prior to your flight to check the seating, in order to avoid disappointment on the day.
AGE: Pleasure Flight Passenger(s) must be at least 5 years of age at the time of flight. Any person under the age of 14 MUST be accompanied by an adult, at all times, including on board the helicopter. Vouchers will need to be purchased for any accompanying adult.
Trial Lesson passenger(s) must be at least 14 years old and be able to reach all controls comfortably, this includes foot controls. Any passenger(s) under the age of 18 must be accompanied by a guardian or consenting adult over the age of 18 for us to conduct the lesson.
CARRIAGE OF DISABLED PERSONS OR PERSONS WITH REDUCED MOBILITY:
Definition - A disabled person or person with reduced mobility (PRM) is any person whose mobility when using transport is reduced due to any physical disability (sensory or locomotor, permanent or temporary), intellectual disability or impairment, or any other cause of disability, or age, and whose situation needs appropriate attention and the adaptation to his or her particular needs of the services available to all passengers.
Any disabled passenger(s) will be required to have a carer with them at all times, including on board the helicopter. A voucher will need to be purchased for any accompanying carer. Restrictions apply depending on the passenger(s) disability, please call our customer services team on 01243 790900 for additional advice.
WEATHER: The pilot conducting your flight experience will assess the weather conditions for that day as early as possible and will inform the passenger(s) either by telephone or text to a mobile if the conditions are deemed unsuitable. If a cancellation occurs due to adverse weather conditions, The Carrier will endeavour to reschedule your flight for a future date at no additional cost. Refunds of vouchers are not made due to weather cancellations and our refund of voucher policy would apply.
ALCOHOL AND DRUGS: Passengers under the influence of alcohol and/or drugs are NOT permitted to take part in a flight or lesson with The Carrier. The Carrier reserves the right to refuse boarding to those whom it suspects to be under the influence of alcohol and/or drugs. This will also VOID the passenger(s) voucher.
VOUCHER REFUNDS, UPGRADES ETC
UPGRADES: Any voucher may be upgraded or credited against another flight for the difference in price between the two experiences. This must be paid before your flight commences. Please contact our customer service team on 01243 790900 to discuss options. Upgrades may be purchased at the branch on the day of your flight, however, will be subject to pilot and aircraft availability.
UNUSED OR UNWANTED VOUCHERS: Vouchers sold through The Carrier have no cash value and are sold as flight products ONLY. Should a recipient not wish to use their voucher, they may pass it to a friend or family member. The new recipient MUST then contact The Carrier to make us aware of the change. The expiry date of the voucher will remain that of the original voucher.
VOUCHER VALIDITY: Each gift voucher is valid for a maximum of twelve months from the date of issue unless otherwise stated. A voucher will be deemed to be invalid if it is out of date (the validity date is clearly stated on the voucher). Vouchers can only be extended if they are still inside their expiry date. If the customer or recipient is unable to utilise the voucher before the expiry date then the voucher can be extended for a further 12 months for a standard admin fee of £25 by contacting us on 01243 790900. All experiences should be booked before the expiry date on the voucher. Where a voucher has been booked but the flight cancelled by The Carrier due to weather or operational reasons and the voucher is within 2 months of its expiry date the voucher will be automatically extended for a further 6 months from the date of voucher expiry without additional cost. Any vouchers purchased through a third-party company and the voucher(s) has been redeemed with The Carrier will be viewed under the section of The Carrier Voucher Validity.
REFUNDS: Vouchers have no cash value and are sold as an experience flight product ONLY. Refunds will only be given to the voucher purchaser minus a £25 administration fee. Refunds are at the company’s discretion and are not issued for weather cancellations or operational circumstances as our policy is to rebook for another date. Should a refund be offered, this will apply to valid (in-date) vouchers ONLY. Refunds on third party vouchers will be determined based on which company the voucher was originally purchased from.
PLEASURE FLIGHT BOOKINGS: Flights for all vouchers except for ‘Family Pack’ vouchers are to be taken on scheduled dates ONLY. All flights will be subject to passenger weights and age restrictions as stipulated. Once a flight has been booked (particularly where it is a single seat) there is no guarantee we would be able to rebook or reschedule your flight.
All flight vouchers purchased, except for the ‘Family Pack’ (FP) voucher (exclusive flights), will be shared flight experiences and therefore should you purchase a single voucher(s) you will be on board with other passengers.
TRIAL LESSON BOOKINGS: All Trial lessons (except the Taster Trial Lesson) are 1:1 experiences and may be taken 7 days a week (subject to pilot and aircraft availability). Taster Trial Lessons are shared experiences to be taken on scheduled dates ONLY. All lessons will be subject to weight and age restrictions as stipulated.
CANCELLATIONS: The Carrier reserves the right to cancel flights at short notice due to factors arising from weather conditions, aircraft serviceability and unforeseen circumstances. Refunds of vouchers are not made due to these cancellations and our refund of voucher policy would apply. The Carrier will not be held responsible for any cost incurred by the passenger in relation to attending the flight, such as costs of travel, accommodation or other associated costs in relation to cancellations. Cancellations will be advised either by telephone or text to the passenger (voucher holder) mobile number provided.
The following terms apply if the passenger (voucher holder) wishes to cancel/reschedule their booked flight date and time;
Up to 7 days prior to the flight date and time: the flight may be rescheduled, with an in date valid voucher ONLY at no additional cost.
7 days and up to 48 hours prior to the flight date and time: the rescheduling of the flight date and time will be at the discretion of The Carrier, this may incur additional costs.
Within 48 hours of the flight date and time: This will VOID your voucher.
FLIGHT TIMES: All vouchers sold are based on flight time. Flight times may vary either way on the day due to air traffic and operational requirements. Interpreted as, when the aircraft blades move under power to when the aircraft blades stop moving. Flight times given are an approximate and should not be regarded as actual. For flights conducted under a ‘rotors running’ scenario, flight time will be classed as aircraft lift off to aircraft touchdown.
FLIGHT SCHEDULING: The Carrier will endeavour to keep as close as possible to the estimated departure time that you have been given. Due to operating from live airfields however, conditions beyond our control may delay departure times. In particular, where multiple flights and single seats have been sold we may experience some late arriving parties. Flights will be allocated as full aircraft on a first come first served basis to minimise any inconvenience caused.
DELAYS: If for operational reasons beyond our control flights become unacceptably delayed, we shall inform the passenger(s) on the day with the new flight schedule and give the passenger(s) the option of re-booking ONLY. Refunds will not be given once you have taken your flight.
LIABILTY: The Carrier flights are operated from busy operating airfields and sites, and therefore will not be held liable for loss, damage or injury to people or property which does not result from their negligence. Non-flying party members will not be allowed airside unless accompanied by a member of staff and is at the discretion of The Carrier. Passengers MUST be accompanied at all times by a member of staff whilst airside and MUST abide by their full instructions.
DANGEROUS GOODS POLICY: Taster Lessons and Pleasure Flights: All passengers, on the day of the flight, will be asked if they have read the Terms & Conditions (T&C’s) and to confirm they are not carrying any of the ‘Dangerous Goods’ detailed in the below picture. The individual or a consenting adult over the age of 18 for a group will be asked to sign to confirm they have read the T&C’s and confirm they (individual or group) are not carrying any of the ‘Dangerous Goods’.
